Houston Harbaugh Secures Federal Trademark Registration for “Defending the Algorithm®”

The Firm’s AI litigation and intellectual property publications, podcasts, and programs are now IP protected by a federally registered trademark, underscoring the growing authority of its Intellectual Property and Litigation practice in the artificial intelligence arena.

Houston Harbaugh, P.C. has received a federal trademark registration and certificate from the United States Patent and Trademark Office (USPTO) for Defending the Algorithm®, the firm’s branded and widely read publication and companion podcast and program series exploring artificial intelligence litigation and law and intellectual property protection, and prosecution.

Created by Houston Harbaugh’s Intellectual Property practice group and the firms AI Committee, Defending the Algorithm® markets itself as “a Lawyer’s Bayesian Analysis of AI Litigation and Law.” The publications and related programs track and interpret the fast-moving legal and ethical issues arising at the intersection of AI and the law, including trade secret misappropriation under the Defend Trade Secrets Act (DTSA), copyright disputes involving generative AI, trademark and patent prosecution strategy, and emerging questions of AI LLM platform liability. Each edition pairs practical guidance for businesses implementing AI tools with strategic insight for defending against AI- and IP-related claims and lawsuits. The firm publishes several newsletters under this brand on Employment Law and Litigation, Insurance Coverage and Bad Faith Litigation, and Corporate, M&A and Transactional Law.
